General Information on Data Processing and Legal Basis

This privacy policy informs you about the nature, scope and purpose of the processing of personal data within our online service and the associated websites, functions and content (hereinafter collectively referred to as "online service" or "website"). This privacy policy applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) on which the online service is operated.

For more information on the terminology used, such as "personal data" or its "processing", please refer to Article 4 of the General Data Protection Regulation (GDPR).

1. Types of Data Processed

The personal data of users processed within the scope of this online service includes:

  • Master data (e.g. names and addresses of customers)

  • Contract data (e.g. services used and payment information)

  • Usage data (e.g. websites visited on our online service, interest in our products)

  • Content data (e.g. entries in contact or newsletter forms)

  • Meta/communication data (e.g. device information and IP addresses)

2. Purpose of Processing

The purpose of processing includes the provision of the online service, its functions and content, answering contact requests and communication with users, security measures and reach measurement, as well as marketing.

3. Categories of Data Subjects

The term "users" includes all categories of persons affected by data processing. These include our business partners, customers, prospects and other visitors to our online service.

4. Storage of Information

We only store personal data of users of this website through the use of online forms and email hyperlinks. Additionally, we may store your data if you send us an email with an inquiry after visiting this website.

5. Security

For security reasons and to protect the transmission of confidential content, such as requests that you send to us via forms or email, we use SSL encryption. You can recognize an encrypted connection by the fact that the browser's address line begins with "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

Additional Security Measures

We take additional organizational, contractual and technical security measures in accordance with the state of the art to ensure that the provisions of data protection laws are complied with and to protect the data we process against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons.

6. Collection of Your Data via Forms

If you send us an inquiry via contact form, your data will be transmitted directly to us by email. It is not stored on external servers.

We store your data for the duration of your inquiry. Mandatory legal provisions - particularly retention periods - remain unaffected. All data is only processed by us and stored on our own server. We do not pass this data on to third parties.

The only exception is the transfer of your data to the provider 'MailerLite', which we use to send our newsletter. Further information on the processing of personal data in this case can be found under point 10 of this privacy policy.

7. Inquiries by Email and Telephone

If you contact us by email or telephone, your inquiry and the resulting personal data (name, email address, etc.) will be stored and processed for the purpose of handling your inquiry.

The data you transmit will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies. Mandatory legal provisions - particularly statutory retention periods - remain unaffected.

8. Where Your Personal Data is Stored

If you transmit your data to us via the website or by email, it will be stored exclusively on our own server and used only for the purpose of fulfilling your request.

The only exception is the transfer of your data to the provider 'MailerLite', which we use to send our newsletter. Further information on the processing of personal data in this case can be found under point 10 of this privacy policy.

9. Transfer of Your Data

We do not pass on your data to third parties unless we are legally obliged to transfer personal data or the transfer is necessary for purposes of national security, taxation or criminal prosecution. The only exception is the transfer of your data to the provider 'MailerLite', which we use to send our newsletter. Further information on the processing of personal data in this case can be found under point 10 of this privacy policy.

10. The Clay Slab Club Newsletter

With the following information, we inform you about the content of our newsletter, the registration, dispatch and statistical evaluation procedures, as well as your rights of objection.

By subscribing to our newsletter, you agree to receive it and to the described procedures.

We only send newsletters, emails and other electronic notifications with advertising information (hereinafter "newsletter") with the consent of the recipients or legal permission.

Newsletter Content

If the content of the newsletter is specifically described during registration, this is decisive for the users' consent. Our newsletters contain reports from our own daily life, recipes, news, (product) recommendations and other information.

Double Opt-In and Logging

Registration for our newsletter is done using a so-called "double opt-in procedure". This means that after registration, you will receive an email asking you to confirm your registration.

This confirmation is necessary so that no one can register using other people's email addresses.

Newsletter registrations are logged in order to verify the registration process in accordance with legal requirements. This includes storing the registration and confirmation times and the IP address. Changes to your data stored with the dispatch service provider are also logged.

Dispatch Service Provider

Newsletters are sent using MailerLite, UAB "MailerLite", J. Basanavičiaus 15, LT-03108 Vilnius, Lithuania.

You can view MailerLite's privacy policy here: https://www.mailerlite.com/legal/privacy-policy

MailerLite has committed to maintaining European data protection standards through Standard Contractual Clauses (see here: https://www.mailerlite.com/legal/data-processing-agreement).

MailerLite stores all data on servers within the European Union (Lithuania) and is ISO 27001 certified.

According to its own information, the dispatch service provider may use this data in anonymized form, i.e. without assignment to the respective user, to optimize or improve its own services, for example for technical optimization of dispatch and presentation of newsletters, or for statistical purposes to determine which countries the recipients come from. However, the dispatch service provider does not use the data of our newsletter recipients to contact them directly or to pass it on to third parties.

Registration Data

To register for the newsletter, it is sufficient if you provide your email address and a name. You can provide your first name, but of course also any other freely chosen name by which you would like to be addressed. This is solely for personal address in the newsletters.

Statistical Collection and Analysis ('Success Measurement')

The newsletters contain a so-called "web beacon". This is a pixel-sized file that is retrieved from the dispatch service provider's server when the newsletter is opened. As part of this retrieval, technical information such as browser and system information, as well as your IP address and time of retrieval, is initially collected. This information is used for technical improvement of services based on technical data or target groups and their reading behavior based on retrieval locations (which can be determined using the IP address) or access times.

Statistical collection also includes determining whether newsletters are opened, when they are opened, and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our goal nor our interest, nor that of the dispatch service provider, to monitor individual users. The analyses are used exclusively to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Unfortunately, separate revocation of success measurement is not possible; in this case, the entire newsletter subscription must be cancelled.

Cancellation and Revocation

You can cancel receipt of our newsletter at any time with one click, i.e. revoke your consent. This simultaneously terminates your consent to its dispatch by the dispatch service provider and statistical analyses. Unfortunately, separate revocation of dispatch by the dispatch service provider or statistical evaluation is not possible. You will find a link to cancel the newsletter at the end of each newsletter. If users have registered for the newsletter and cancelled this registration, their personal data will be deleted.

The use of the dispatch service provider, implementation of statistical collections and analyses, and logging of the registration procedure are based on our legitimate interests in accordance with Art. 6 Para. 1 lit. f GDPR. Our interest is directed toward the use of a user-friendly and secure newsletter system that serves both our interests and meets users' expectations.

11. Your Rights

You have the right to request confirmation as to whether relevant data is being processed and to receive information about this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.

In accordance with Art. 16 GDPR, you have the right to request the completion of data concerning you or the correction of incorrect data concerning you.

In accordance with Art. 17 GDPR, you have the right to request that relevant data be deleted immediately, or alternatively, in accordance with Art. 18 GDPR, to request a restriction on the processing of the data.

You have the right to request that the data concerning you that you have provided to us be received in accordance with Art. 20 GDPR and to request its transmission to other controllers.

In accordance with Art. 77 GDPR, you have the right to lodge a complaint with a competent supervisory authority.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at the following address: https://ec.europa.eu/consumers/odr

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and are generally not willing to do so.

13. If You Change Your Mind

For communication with you, we use your preferred method, which you can specify in our online forms or by email. If you would like to change these preferences (e.g. from email to post), please contact us by email at hello@clayslab.club.

Users may object to future processing of their personal data in accordance with legal requirements at any time. The objection can be made in particular against processing for direct marketing purposes.

14. Changes to the Privacy Policy

We revise these privacy notices when there are changes to this website or on other occasions that make this necessary. However, this only applies with regard to statements on data processing. If users' consent is required, or if components of the privacy policy contain regulations of the contractual relationship with users, changes will only be made with users' consent.

You will always find the current version on this website. If you have any questions about data protection, please feel free to contact us.
