§ 1 Scope

These Terms and Conditions (“Terms”) of Femke Bencivinni-Peter, trading as Clay Slab Club, Lönsweg 1, 31832 Springe, Germany (“we”, “us”, “our”), apply to all purchases made through the online shop at clayslab.club.

Our offer is directed at consumers (individuals purchasing for personal, non-commercial purposes) as well as business customers. Any terms and conditions of customers do not apply unless expressly agreed otherwise.

Our offer includes digital products (templates, courses and the Studio Starter Kit), the Club membership, the Studio License, vouchers and physical goods (e.g. tools). Additional terms may apply to specific product categories as described in the relevant sections of these Terms.

Minors require the consent of their parent or legal guardian to make a purchase.

§ 2 Contract Formation

When you add a product to your cart on clayslab.club and complete your order, you are submitting a binding offer to purchase. Product pages do not constitute an offer on our part. They are an invitation to purchase.

We accept your offer by sending you an order confirmation by email or, for digital products, by making the download available to you immediately. The purchase contract is formed at this point.

You may correct your entries at any time until you click the final order button. After completing your order, we will send you these Terms along with your order confirmation by email.

The language of the website is English. However, these Terms and their German version are legally binding. In case of any discrepancy between the English and German versions, the German version shall prevail.

We store the contract text internally. It is not accessible via the website after your order is completed. You will, however, receive it with your order confirmation by email.

§ 3 Right of Withdrawal

As a consumer, you generally have the right to withdraw from a purchase within 14 days without giving any reason.

How to Withdraw

Use the “Withdraw from contract” button in the footer of every page on clayslab.club, or send us a clear statement by email to hello@clayslab.club. To meet the deadline, it is sufficient to send your withdrawal before the 14-day period has expired.

Digital Products (Downloads)

For digital content, including templates, courses and the Studio Starter Kit, the right of withdrawal expires as soon as the download has started. This requires that you have expressly agreed, prior to purchase, that we may begin delivery immediately, and that you have acknowledged that you thereby lose your right of withdrawal. This consent is obtained during checkout and confirmed in your order confirmation email.

Club Membership

For the Club membership, the 14-day right of withdrawal applies from the day the contract is concluded.

Physical Products (e.g. tools)

For physical goods, the 14-day withdrawal period begins on the day you receive the item. You are responsible for the cost of return shipping. The item must be returned complete and undamaged. We will process your refund within 14 days of receiving the return.

§ 4 Prices and Payment

All prices shown are final prices in euros and include the applicable VAT.

Available payment methods will be displayed during checkout. Payment is due upon completion of your order. Memberships are paid in advance for each billing period.

For purchases from outside the EU, additional costs may apply, such as bank fees or import duties. These are beyond our control and are your responsibility.

§ 5 Delivery and Access

Digital Products

After successful payment, you will promptly receive an email containing your download link. Access is usually provided immediately, and at the latest within 24 hours. If you don’t receive the email, please check your spam folder first, then feel free to get in touch.

Club Membership

Access to the members area starts immediately after successful payment.

Physical Products

Physical goods are shipped within the European Union only. Estimated delivery times are indicated on the relevant product page. Shipping costs are shown separately during checkout.

§ 6 Vouchers

Promotional vouchers (issued free of charge, e.g. as part of discount campaigns) may only be redeemed in the shop at clayslab.club and are subject to a specified validity period. They may only be applied before completing an order. Subsequent crediting is not possible. Only one voucher may be redeemed per order. Any remaining balance will not be refunded.

Gift vouchers (purchased) are valid for three years from the date of purchase and may likewise only be redeemed at clayslab.club. They are transferable but cannot be exchanged for cash.

§ 7 Membership

The Clay Slab Club membership (“Club”) gives you access to:

• one new project every month (template and videos), available to members two months before it appears in the shop

• the Club Collection, a curated template collection for members

• the Video Library with all our courses

• mini projects, quick skills, printable glazing cards, illustrations and exclusive newsletter content for members

• everything included in the Studio Starter Kit

The monthly project is the current release. It is not possible to choose a different template from the existing range instead.

Templates you download during your membership are yours to keep, even after your membership ends. Access to the Video Library and all other member content ends with your membership.

Term and Cancellation

Annual membership: The initial term is 12 months. After that, the membership continues for an indefinite period and can be cancelled at any time with 14 days’ notice. To end your membership at the end of the initial term, your cancellation must reach us no later than 14 days before it ends.

Monthly membership: The membership can be cancelled at any time, effective at the end of the current billing month.

You can cancel using the “Cancel contract here” button in the footer of every page on clayslab.club, in your members area, or by email to hello@clayslab.club.

Exact pricing is shown at checkout. Founding members keep their founding price for as long as their membership remains active and uninterrupted.

§ 8 Warranty

For digital products: if a download is faulty or inaccessible, we will resolve the issue promptly by providing a new download link. Please contact us by email at hello@clayslab.club in this case.

For physical products, statutory warranty rights apply.

§ 9 Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.

§ 10 Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Intellectual Property and Studio License

By purchasing a digital product from Clay Slab Club, you receive a simple, non-transferable license for personal use. In short: don’t sell the template, sell what you made.

What you may do:

• Use the projects for your own pottery practice

• Print the templates larger or smaller for your own use

• Sell finished ceramic pieces you have made using our projects

What is not permitted:

• Sharing, distributing or reselling the files

• Altering the templates in any way other than scaling them, or selling altered versions of them

• Copying the files or passing off our designs as your own

• Using the projects in classes, workshops or a studio setting without a Studio License

Studio License

Ceramic studios and teachers who want to teach Clay Slab Club templates in their own classes need a Studio License. The license covers all Clay Slab Club templates you have purchased. It is valid for 12 months from the date of purchase and must be renewed annually. For pricing, details and to purchase, contact us at hello@clayslab.club.

Club members also need a separate Studio License to teach with our templates.

§ 12 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence, we are only liable for the breach of essential contractual obligations, limited to the typical, foreseeable damage. Otherwise, our liability is excluded.

Pottery involves sharp tools, kilns and ceramic materials. Please follow the safety instructions of your tool, material and kiln manufacturers. Working with them is your own responsibility.

For technical issues with digital products, such as faulty downloads, we will resolve the problem promptly in accordance with § 8 of these Terms.

§ 13 Legal Notice

§ 14 Privacy

The processing of personal data in connection with the purchase process is carried out in accordance with our Privacy Policy, available at clayslab.club.

§ 15 Changes to These Terms

We reserve the right to update these Terms where necessary, for example when adding new product categories or in response to legal changes. Existing customers will be informed of significant changes by email. The current version is always available at clayslab.club.

§ 16 Copyright

All content on clayslab.club, including texts, photos, videos, graphics and designs, is protected by copyright and is the property of Femke Bencivinni-Peter. Any use, reproduction or distribution without express written permission is not permitted.

§ 17 Availability and Product Changes

We reserve the right to remove products from our range, adjust prices, or update the content of the Video Library and other member content. Previously purchased templates remain accessible for a minimum of 12 months from the date of purchase. After this period, we will make every effort to maintain access for as long as possible, but cannot guarantee indefinite availability. For members: changes to library content do not entitle you to extraordinary cancellation, as long as the core scope of services remains intact.

§ 18 Technical Requirements

To use our digital products, you will need a suitable device and the necessary software to open the files (e.g. a PDF reader). We are not liable if products cannot be used due to technical limitations on your end.

§ 19 Communication by Email

Official communication between us, such as order confirmations, download links and withdrawal notices, takes place by email. You are responsible for ensuring that the email address you provide is correct and accessible, and that emails from clayslab.club do not end up in your spam folder.

§ 20 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control, including technical outages at third-party providers (e.g. Squarespace server failures), natural disasters or other unforeseeable events. In such cases, we will inform you as quickly as possible and work to resolve the issue.

§ 21 Severability

Should any provision of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by a valid one that comes closest to the economic purpose of the original provision.
