TERMS AND CONDITIONS

§ 1 Scope

These Terms and Conditions ("Terms") of Femke Peter, Lönsweg 1, 31832 Springe, Germany ("we", "us", "our"), apply to all purchases made through the online shop at clayslab.club.

Our offer is directed at consumers — individuals purchasing for personal, non-commercial purposes — as well as business customers. Any terms and conditions of customers do not apply unless expressly agreed otherwise.

Our offer includes digital products (e.g. pottery projects for download), physical goods (e.g. tools, merchandise) and vouchers. Additional terms may apply to specific product categories as described in the relevant sections of these Terms.

Minors require the consent of their parent or legal guardian to make a purchase.

§ 2 Contract Formation

When you add a product to your cart on clayslab.club and complete your order, you are submitting a binding offer to purchase. Product pages do not constitute an offer on our part — they are an invitation to purchase.

We accept your offer by sending you an order confirmation by email — or, for digital products, by making the download available to you immediately. The purchase contract is formed at this point.

You may correct your entries at any time until you click the final "Buy" button. After completing your order, we will send you these Terms along with your order confirmation by email.

The language of the website is English. However, these Terms and their German version are legally binding. In case of any discrepancy between the English and German versions, the German version shall prevail.

We store the contract text internally. It is not accessible via the website after your order is completed — however, you will receive it with your order confirmation by email.

§ 3 Right of Withdrawal

As a consumer, you generally have the right to withdraw from a purchase within 14 days without giving any reason.

Digital Products (Downloads)

For digital content — including all pottery projects, guides and bundles available for download — the right of withdrawal expires as soon as the download has started. This requires that you have expressly agreed, prior to purchase, that we may begin delivery immediately, and that you have acknowledged that you thereby lose your right of withdrawal. This consent is obtained during the checkout process.

Physical Products (e.g. tools, merchandise)

For physical goods, the 14-day withdrawal period begins on the day you receive the item. To exercise your right of withdrawal, please contact us by email at hello@clayslab.club. You are responsible for the cost of return shipping. The item must be returned complete and undamaged. We will process your refund within 14 days of receiving the return.

The right of withdrawal does not apply to customers residing outside the European Union.

§ 4 Prices and Payment

All prices shown are final prices in euros. As a small business owner within the meaning of § 19 of the German VAT Act (UStG), we do not charge VAT.

Available payment methods will be displayed during the checkout process. Payment is due upon completion of your order.

For purchases from outside the EU, additional costs may apply — such as bank fees or import duties — which are beyond our control and are your responsibility.

§ 5 Delivery and Access

Digital Products

After successful payment, you will promptly receive an email containing your download link. Access is usually provided immediately, and at the latest within 24 hours. If you don't receive the email, please check your spam folder first — and then feel free to get in touch.

Physical Products

Physical goods are shipped within the European Union only. Estimated delivery times are indicated on the relevant product page. Shipping costs are shown separately during checkout.

We do not ship outside the EU.

§ 6 Vouchers

Promotional vouchers (issued free of charge, e.g. as part of discount campaigns) may only be redeemed in the shop at clayslab.club and are subject to a specified validity period. They may only be applied before completing an order — subsequent crediting is not possible. Only one voucher may be redeemed per order. Any remaining balance will not be refunded.

Gift vouchers (purchased) are valid for three years from the date of purchase and may likewise only be redeemed at clayslab.club. They are transferable but cannot be exchanged for cash.

§ 7 Membership

[DO NOT PUBLISH YET – to be activated when Membership goes live]

A Clay Slab Club membership gives you access to:

- the Video Library with how-tos, techniques and educational content on slab building

- the Mini Project Library with all previously released Mini Projects

- exclusive newsletter content for members

- one new Template per month — members receive it one month before it appears in the regular shop

The monthly Template is the current release — it is not possible to choose from the existing range.

The membership runs for a minimum of 12 months and renews automatically unless cancelled in time. Cancellation must be received no later than 14 days before the end of the contract year, either by email to hello@clayslab.club or via your personal members area on clayslab.club.

Exact pricing is shown during the booking process. Founding members keep their entry price for life — as long as their membership remains active and uninterrupted.

§ 8 Warranty

For digital products: if a download is faulty or inaccessible, we will resolve the issue promptly by providing a new download link. Please contact us by email at hello@clayslab.club in this case.

For physical products, statutory warranty rights apply.

§ 9 Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.

§ 10 Dispute Resolution

The European Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Intellectual Property and Studio License

By purchasing a digital product from Clay Slab Club, you receive a simple, non-transferable license for personal use. This means:

What you may do:

- Use the projects for your own personal pottery practice

- Sell finished ceramic pieces you have made using our projects

What is not permitted:

- Sharing, distributing or reselling the files

- Copying, modifying or presenting the content as your own work

- Using the projects in classes, workshops or a studio setting — a Studio License is required for this

Studio License

Ceramic studios and teachers may purchase a Studio Annual License. This license permits the use of all Clay Slab Club templates you have purchased in your own classes and teaching. The license is valid for 12 months from the date of purchase and must be renewed annually. The price is 49,00 € per year. For details and to purchase, contact us at hello@clayslab.club.

Members (Membership) also require a separate Studio License for teaching use.

§ 12 Liability

We are not liable for any damages arising from the use of our instructions, material recommendations or projects. All work is carried out entirely at your own risk — particularly when working with kilns, tools and ceramic materials.

For technical issues with digital products — such as faulty downloads — we will resolve the problem promptly in accordance with § 8 of these Terms.

§ 13 Legal Notice

§ 14 Privacy

The processing of personal data in connection with the purchase process is carried out in accordance with our Privacy Policy, available at clayslab.club.

§ 15 Changes to These Terms

We reserve the right to update these Terms where necessary — for example, when adding new product categories or in response to legal changes. Existing customers will be informed of significant changes by email. The current version is always available at clayslab.club.

§ 16 Copyright

All content on clayslab.club — including texts, photos, videos, graphics and designs — is protected by copyright and is the property of Femke Peter. Any use, reproduction or distribution without express written permission is not permitted.

§ 17 Availability and Product Changes

We reserve the right to remove products from our range, adjust prices, or update the content of the Video Library and Mini Project Library. Previously purchased templates remain accessible for a minimum of 12 months from the date of purchase. After this period, we will make every effort to maintain access for as long as possible, but cannot guarantee indefinite availability. For membership holders: changes to library content do not entitle you to extraordinary cancellation, as long as the core scope of services remains intact.

§ 18 Technical Requirements

To use our digital products, you will need a suitable device and the necessary software to open the files (e.g. a PDF reader). We are not liable if products cannot be used due to technical limitations on your end.

§ 19 Communication by Email

Official communication between us — such as order confirmations, download links and withdrawal notices — takes place by email. You are responsible for ensuring that the email address you provide is correct and accessible, and that emails from clayslab.club do not end up in your spam folder.

§ 20 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control — including technical outages at third-party providers (e.g. Squarespace server failures), natural disasters or other unforeseeable events. In such cases, we will inform you as quickly as possible and work to resolve the issue.

§ 21 Severability

Should any provision of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be deemed replaced by a valid one that comes closest to the economic purpose of the original provision.
